1. Acceptance of Terms

By accessing or using the EIGLOU POS service (“Service”), provided by EIGLOU (“EIGLOU POS,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, you may not use the Service. If you use the Service on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

2. Eligibility and Accounts

To use the Service, you must create an account with accurate, complete, and current information. You are responsible for:

Maintaining the confidentiality of your password and account credentials;
All activity that occurs under your account; and
Notifying us promptly of any unauthorized access or suspected breach.

You must be at least 18 years old and able to enter into a binding agreement.

3. Service Description

Eiglou POS is a point-of-sale system designed for retailers and pharmacies, which may include sales and transaction management, inventory and stock tracking, customer records, accounting and financial reporting, purchase order tools, and English and Urdu support.

The Service is evolving. Features may be added, changed, or removed over time. Any features described as “coming soon,” planned, or in development are provided for information only, are not guaranteed, and may change or not be released.

4. Free Plan and Fair Use

The Service offers a free plan at no cost to start, with no credit card required. The free plan is subject to fair-use limits that help us maintain service quality for all users. These limits currently include a maximum of 20 products (SKUs) and may include other restrictions on transaction volume, data storage, or usage.

Current free-plan limits are subject to change. We may modify fair-use limits, and we will provide reasonable notice (for example, around 30 days) of material changes that reduce limits for existing free-plan accounts. Excessive use, or use that places an unreasonable load on the Service, may result in throttling, suspension, or a requirement to upgrade to a paid plan.

5. Paid Plans and Pricing

We may offer paid plans and optional add-ons. Pricing, plan features, and limits may change over time. Any paid plan terms, billing cycles, and applicable taxes will be presented to you before you subscribe. Continued use of a paid plan after a price change takes effect constitutes acceptance of the new price.

6. Acceptable Use

You agree not to use the Service to:

Conduct or facilitate illegal activity, fraud, or money laundering;
Gain unauthorized access to any system, account, or data;
Upload malicious code or interfere with the operation or security of the Service;
Infringe the rights of others; or
Take any action that harms the Service, other users, or us.

Violation may result in immediate suspension or termination of your account.

7. Your Data and Your Customers’ Data

You retain all rights to the business data you enter into the Service, including sales records, inventory, and customer information (“Your Data”). You grant us a limited license to host, process, and use Your Data solely to provide and improve the Service and as described in our Privacy Policy.

Where Your Data includes information about other people (such as your customers, staff, or suppliers), you confirm that you have the right and any necessary consent to provide that information to us, and that you will handle it in line with applicable law. You are solely responsible for the accuracy and lawfulness of the data you enter.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

9. Intellectual Property

The Service, including its software, design, text, graphics, and trademarks, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes in accordance with these Terms. You may not copy, modify, reverse-engineer, resell, or create derivative works from the Service except as permitted by law.

10. Third-Party Services

The Service may integrate with or rely on third-party services (for example, hosting, payment channels, or messaging providers). We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them may be subject to their own terms.

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

While the Service includes accounting, tax-related, and reporting features, you are responsible for verifying all figures, records, and outputs, and for your own tax, accounting, and regulatory compliance. The Service is a tool and is not a substitute for professional accounting, tax, or legal advice. We do not warrant that the Service will be uninterrupted, error-free, or that any data, report, or calculation will be accurate or complete.

12. Limitation of Liability

To the maximum extent permitted by law, in no event will Eiglou POS, its owners, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, or for any tax penalties, regulatory penalties, or third-party claims, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) PKR 5,000.

13. Indemnification

You agree to indemnify and hold harmless Eiglou POS and its owners, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, the data you enter, or your breach of these Terms or of applicable law.

14. Service Availability, Modification, and Discontinuation

We may modify, suspend, or discontinue any feature, the free plan, or the Service, in whole or in part, at any time, with or without notice. We will use reasonable efforts to give advance notice of significant changes that materially affect active users. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Suspension and Termination

Either party may terminate the account at any time. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms or applicable law, or to protect the Service or other users. Upon termination, you generally have a limited period (typically around 30 days) to export Your Data, after which we may delete it as described in our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after the changes take effect means you accept the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan. You agree that the courts of Lahore, Pakistan, will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory rights you may have under applicable law.
